1. Agreement
These Terms govern access to CaughtUp’s website, Chrome extension, and related services. “CaughtUp,” “we,” and “us” refer to the owner and operator of the CaughtUp service. These Terms are effective August 10, 2026. By using the service, you agree to these Terms and the Privacy Policy.
2. Eligibility
You must be at least 18 years old, or the age of legal majority where you live, and able to enter these Terms. If you use CaughtUp for an organization, you represent that you have authority to bind that organization.
3. Accounts and connections
You are responsible for your account activity, the accuracy of information you provide, and maintaining the security of accounts you connect. Google and TikTok Shop are authorized separately. You must use only accounts and data you are permitted to access.
4. Acceptable use
You may not use CaughtUp to violate law or another person’s rights; send spam, deception, harassment, or unlawful content; bypass platform security or rate limits; probe another user’s data; upload malicious code; or misrepresent automated output as a binding commitment made by another person.
5. Drafts and commercial decisions
CaughtUp provides assistance, not legal, financial, tax, or professional advice. You are responsible for reviewing recipients, attachments, draft content, prices, availability, deliverables, licenses, deadlines, and every other commercial term before sending or agreeing to anything.
Negotiation suggestions and opportunity rankings are informational. CaughtUp does not accept, reject, counter, reserve availability, or enter a contract for you. Enabling an available Auto-send setting is a user-controlled choice and does not transfer responsibility for account activity.
6. No guaranteed outcomes
CaughtUp does not guarantee brand acceptance, campaign selection, product availability, sales, conversion, commission, earnings, or any particular business result. Estimates and match scores are directional and depend on source information that may change.
7. Third-party services
CaughtUp depends on services such as Google, Gmail, TikTok Shop, Supabase, browsers, and a configured language-model provider. Those services may change, suspend access, experience outages, or enforce their own terms. We are not responsible for third-party services outside our control.
8. Content and intellectual property
You retain ownership of content and media kits you provide. You grant CaughtUp a limited license to host, process, reproduce, and transmit that content only as needed to provide and secure the service. CaughtUp and its original software, design, and branding remain the property of their respective owner.
You are responsible for ensuring you have rights to upload and use your content. Feedback may be used to improve CaughtUp without an obligation to compensate you, provided it does not publicly identify you without permission.
9. Suspension and termination
You may stop using CaughtUp and disconnect supported accounts. We may suspend or terminate access when reasonably necessary to address security risk, unlawful or abusive use, material breach, or third-party platform requirements. Account-data deletion is handled under the Privacy Policy.
10. Disclaimers and liability
To the extent permitted by law, CaughtUp is provided “as is” and “as available,” without warranties of uninterrupted operation, fitness for a particular purpose, non-infringement, or accuracy of generated or third-party information.
To the fullest extent permitted by law, CaughtUp will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, opportunities, commissions, or business arising from use of the service. CaughtUp’s aggregate liability for claims relating to the service will not exceed the greater of the amount you paid for the service during the twelve months before the claim or US $100. Some jurisdictions do not allow certain exclusions or limitations, so those limits may not apply to you.
11. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute that may be heard in court will be brought in a state or federal court located in California, and each party consents to that court’s jurisdiction, except where applicable consumer law requires otherwise.
12. Changes
We may update these Terms as the service changes. The published version will identify an effective date, and material changes will be communicated through an appropriate product or account notice.
